Open letter to the Members of the UN Security Council

We, signatory Haitian organizations and individuals, wish to renew our previous observations, on the eve of the decisive meeting of September 15 of the Council where you will, based on a proposed resolution emanating from the United States of America, consider the question of whether or not to send a “Multinational Force” to Haiti whose fundamental mission would be to “fight” armed gangs. We also have the honor of sending you a copy of two recent correspondences addressed to the African Union and to the Representative of the Russian Federation, respectively, which present an updated picture of the situation.

Honorable Members of the Security Council

The tragic situation experienced on a daily basis by countless Haitian families following the exploitation of these gangs leads us to emphasize the following facts:

1- THE U.S. GOVERNMENT’S CONTEMPT OF THE SECURITY COUNCIL RESOLUTION (2653/2022)

A report [1] from the United Nations Office on Drugs and Crime (UNODC) made public in March 2023 confirms that the weapons and ammunition used by gangs come in particular from the United States of America, from the state of Florida. This amounts to saying that the US, which is planning to send a multinational force, and is a designer of this proposed resolution for the purpose of obtaining a UN mandate, is overwhelmingly responsible for the delivery of arms and ammunition to the gangs that they paradoxically intend to help us fight through the said multinational force.

Note that Resolution 2653[2] adopted by the Security Council on October 21, 2022 prohibits arms trafficking from UN member states to Haiti. Eleven months after the vote to pass this resolution for the Haitian people terrorized by gangs, how can we understand the flagrant non-compliance by the US, a member state of the UN, which had also voted for the resolution?

2- THE UNITED NATIONS’ INDIFFERENCE TOWARDS THE APPLICATION OF THE PRINCIPLES OF ITS OWN CHARTER

In the preamble of the UN Charter the following is written, among other things:

“WE, THE PEOPLES OF THE UNITED NATIONS DETERMINED…to reaffirm faith in fundamental human rights, in the dignity and worth of the human person, in the equal rights of men and women and of nations large and small…” [3]

Chapter I: Points and principles, article 1, section 2 outlines that the goals of the United Nations are: “To develop friendly relations among nations based on respect for the principle of equal rights and self-determination of peoples, and to take other appropriate measures to strengthen universal peace;” [4]

Article 2, sections 1 and 4 read: “The Organization is based on the principle of the sovereign equality of all its Members…All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations” [5]

Do these actions conform to the principles enshrined in its Charter when the UN accepts:

– to support the illegitimate de facto government of Ariel Henry with an indefinite mandate

– to accept a request for occupation from this same usurper who has neither the authority nor the legal mandate to authorize our country’s engagement in an approach which represents a crime of high treason under the Haitian Constitution (Art. 21.1)

– to offer deafening silence with regards to the obvious and revolting complicity of Ariel Henry with the activities of the armed gangs. From January to August 2023, the increasing violence of armed gangs has already caused more than 2400 deaths [6] among our compatriots.

Moreover, how can the UN now claim integrity and public morality by signing and approving the presence of a new occupation mission while its hands are already heavily stained with the blood of thirty thousand Haitian victims of the crime of cholera perpetrated by the mission known as MINUSTAH. Enough is enough! Our country has already survived many bitter experiences of foreign occupation which are in large part responsible for the severity and worsening of the current situation.

Honorable Members of the Security Council

Imagine for a moment:

-A scenario in which the gangs would be totally cut off from their main supplies of weapons and munitions. They would be weakened and rendered ipso facto incapable of terrorizing people, of consolidating power and taking advantage of the chaos, and of justifying the unnecessary deployment of the occupation force that the US and its allies want to impose on us.

–Simply obtaining US compliance with Security Council Resolution 2653 (2022) relating to the prohibition of arms trafficking to Haiti, which has been in place since October 2022. This would rapidly facilitate a decrease in gang violence;

–The immediate suspension of the unspeakable international support for the de facto government of Ariel Henry which provides terrorist gangs with the impunity and protection that makes them so powerful and destructive. Without resorting to unnecessary foreign intervention, fighting the gangs would in turn become easy;

–Obtaining a guarantee of unwavering international support for the creation of a new government made up of men and women of character, honesty, and integrity, who would not/will not collude with armed gangs like the current de facto government. This materialization of international solidarity would lead to a promising outcome in Haiti;

–Purging the gangsterized Haitian National Police and obtaining a true international agreement concretely supporting the new Police force would guarantee, alongside other social measures, certain security.

Consideration of the five points mentioned, among others, is enough to radically change the situation and bring security and lasting peace to Haiti. In turn, there will no longer be a need to consider a foreign military intervention to systematically combat these armed gangs which sow terror and poison the lives of the people.

Honorable Members of the Security Council,

-Voting on a resolution authorizing the US and its allies to deploy an occupying force to our country, under these conditions, is a violation of the UN Charter, which is founded on the principle of sovereign equality of all its Members. Haiti, like the US, is a member state. It must benefit in the same way from the principle of sovereign equality.

-Voting for this resolution, which will be proposed by the US on September 15, is to dissociate oneself from the solemn commitment to recognize the equal rights of nations large and small.

-Voting for such a resolution means resorting to the use of force against the territorial integrity and political independence of Haiti. This is in fact incompatible with the purposes of the United Nations.

Finally, voting for such a resolution means renouncing the purposes and principles consisting in particular of “Developing friendly relations between nations based on respect for the principle of equal rights of peoples and their right to self-determination” [7]

Honorable Members of the Security Council

We, signatory Haitian organizations and individuals, wish, in this tragic and difficult moment of our history, to count on your elevated sense of solidarity and your unwavering dedication to the founding values of the UN. We want to maintain the firm conviction that you will not fail to take a position in favor of the sovereignty of the Haitian People and therefore, against any resolution violating their right to self-determination.

Lettre ouverte aux membres du Conseil de Sécurité de l’Organisation des Nations-Unies (ONU)

Nous, organisations et personnalités haïtiennes signataires, tenons à renouveler nos considérations antérieures à la veille de la rencontre décisive du 15 septembre du Conseil où vous aurez, à partir d’une proposition de résolution émanant des Etats-Unis d’Amérique à vous pencher sur la question de l’envoi ou non en Haïti d’une » Force multinationale » qui aurait comme mission fondamentale de « combattre » les gangs armés. Nous avons également l’honneur de vous transmettre la copie de deux récentes correspondances adressées respectivement à l’Union Africaine et au Représentant de la Fédération de Russie, correspondance présentant un tableau actualisé de la situation.

Honorables Membres du Conseil de Sécurité

La situation tragique vécue au quotidien par d’innombrables familles haïtiennes suite à l’instrumentalisation de ces gangs nous porte à insister sur les faits suivants :

1- LE MEPRIS PAR LE GOUVERNEMENT ETATSUNIEN DE LA RESOLUTION DU CONSEIL DE SECURITE (2653/2022)

Un rapport [1] de l’Office des Nations Unies contre la Drogue et le Crime (ONUDC) rendu public en mars 2023 confirme que les armes et munitions utilisées par les gangs proviennent en particulier des Etats-Unis d’Amérique, à partir de l’Etat de Floride. Ce qui revient à dire que les USA, à la manœuvre pour l’envoi d’une telle force et concepteur de cette proposition de résolution aux fins d’obtenir le mandat de l’ONU, a visiblement une accablante responsabilité dans l’acheminement d’armes et de munitions aux gangs qu’ils entendent paradoxalement nous aider à combattre par le biais de ladite force multinationale.

À souligner que la Résolution 2653[2] adoptée par le Conseil de Sécurité le 21 octobre 2022 interdit le trafic d’armes des Etats-membres de l’ONU vers Haïti. Onze mois après le vote d’une telle résolution aussi salutaire pour le Peuple Haïtien terrorisé par les gangs, comment comprendre son non-respect flagrant par les USA, Etat-membre de l’ONU qui l’avait également votée ?

2- L’INDIFFERENCE DE L’ONU CONCERNANT L’APPLICATION DES PRINCIPES FONDAMENTAUX DE SA PROPRE CHARTE

Au préambule de la Charte des Nations Unies Il est écrit, entre autres :

« NOUS, PEUPLES DES NATIONS UNIES, RÉSOLUS…à proclamer à nouveau notre foi dans les droits fondamentaux de l’homme, dans la dignité et la valeur de la personne humaine, dans l’égalité de droits des hommes et des femmes, ainsi que des nations, grandes et petites… »[3]

Au chapitre I: Buts et principes, article 1, point 2, il est précisé que les buts des Nations Unies sont de : « Développer entre les nations des relations amicales fondées sur le respect du principe de l’égalité de droits des peuples et de leur droit à disposer d’eux-mêmes, et prendre toutes autres mesures propres à consolider la paix du monde; »[4]

A l’article 2, points 1 et 4, nous lisons : « L’Organisation est fondée sur le principe de l’égalité souveraine de tous ses Membres …Les Membres de l’Organisation s’abstiennent, dans leurs relations internationales, de recourir à la menace ou à l’emploi de la force, soit contre l’intégrité territoriale ou l’indépendance politique de tout État, soit de toute autre manière incompatible avec les buts des Nations Unies » [5]

S’agit-il d’actions conformes aux principes inscrits dans sa Charte quand l’ONU accepte :

– d’appuyer le gouvernement illégitime de facto d’Ariel Henry avec un mandat indéfini

– d’accepter une demande d’occupation de ce même usurpateur de titre qui n’a ni qualité ni provision légale l’autorisant à engager notre pays dans une telle démarche qui représente au regard de la Constitution haïtienne un crime de haute trahison (Art.21.1)

– d’observer un silence assourdissant sur la complicité manifeste et révoltante d’Ariel Henry avec les gangs armés. De janvier à aout 2023, la violence accrue des gangs armés en mission commandée a déjà causé plus de 2400 morts [6] parmi nos compatriotes.

En outre, au nom de quelle intégrité et moralité publique l’ONU peut-elle désormais se prévaloir en signant et validant la présence d’une nouvelle mission d’occupation alors que ses mains sont encore lourdement empreintes du sang des trente mille Haïtiens-Haïtiennes victimes du crime de choléra perpétré par la Mission dite MINUSTAH. Trop c’est trop ! Notre pays a déjà vécu diverses expériences amères d’occupation étrangère qui sont en majeure partie à l’origine de l’aggravation vertigineuse de la situation actuelle.

Honorables Membres du Conseil de Sécurité

Imaginez un instant :

-Le scenario où les gangs seraient totalement coupés de leurs principales sources d’approvisionnement en armes et minutions. Ils seraient ipso facto affaiblis et rendus ainsi incapables de terroriser le peuple, de consolider cette situation chaotique justifiant le déploiement inutile de cette force d’occupation que les USA et alliés tiennent à nous imposer

–Le simple fait de l’obtention du respect par les Etats-Unis d’Amérique de la Résolution 2653(2022) adoptée depuis octobre 2022 par le Conseil de Sécurité relative à l’interdiction du trafic d’armes vers Haïti. Cela permettrait de diminuer rapidement la violence des gangs ;

–la suspension immédiate de l’appui international inqualifiable au gouvernement de facto d’Ariel Henry assurant aux gangs terroristes cette entière impunité et protection qui les rendent si puissants et si destructeurs. Ainsi, combattre les gangs sans recours inutile à l’intervention étrangère deviendrait facile ;

-, l’obtention de la garantie d’un support international sans faille à l’avènement à la tête de notre pays d’une nouvelle équipe gouvernementale composée d’hommes et de femmes politiques de caractère, honnêtes, intègres qui ne seraient/seront pas de connivence avec les gangs armés, à l’instar de l’actuel gouvernement de facto. Ce serait la matérialisation d’une solidarité internationale agissante bénéfique qui conduirait Haïti vers une issue heureuse ;

–la concrétisation de l’épuration de la Police Nationale d’Haïti gangstérisée et une véritable entente internationale relative au soutien concret à accorder à la nouvelle Police épurée garantirait, à côté d’autres mesures sociales, une sécurité certaine.

La considération, entre autres, de ces cinq points relatés suffit à changer radicalement la donne et à ramener la sécurité et la paix durable en Haïti. Donc point n’est besoin dans ce cas d’envisager une intervention militaire étrangère pour parvenir à combattre systématiquement ces gangs armés qui sèment la terreur et empoisonnent la vie du peuple.

Honorables Membres du Conseil de Sécurité,

-Voter une résolution octroyant un mandat habilitant les USA et alliés à déployer dans notre pays, dans ces conditions, une force d’occupation est une violation de la charte de l’ONU, fondée sur le principe de l’égalité souveraine de tous ses Membres. Haïti comme les USA est un pays membre. Elle doit bénéficier au même titre de ce principe de l’égalité souveraine.

-Voter cette résolution qui sera proposée le 15 septembre par les USA c’est se désolidariser de cette proclamation solennelle reconnaissant l’égalité de droits des nations, grandes et petites.

-Voter une telle résolution c’est recourir à l’emploi de la force contre l’intégrité territoriale et l’indépendance politique d’Haïti. Cela est de fait incompatible avec les buts des Nations Unies.

Enfin, voter une telle résolution c’est renoncer aux buts et principes consistant notamment à « Développer entre les nations des relations amicales fondées sur le respect du principe de l’égalité de droits des peuples et de leur droit à disposer d’eux-mêmes » [7]
